Please read these terms carefully before using TrueCare Healthcare.
These Terms of Service ("Terms") govern your access to and use of the TrueCare Healthcare website, mobile experience, and related services (collectively, the "Platform"), operated by TrueCare Healthcare ("TrueCare," "we," "us," or "our"), based in New York.
By creating an account, applying as a caregiver or vendor, posting a care request, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
TrueCare Healthcare is an online marketplace that helps families ("Clients") connect with independent caregivers ("Caregivers") for home health aide services, senior companionship, childcare, post-surgery recovery support, and related care. TrueCare also operates a directory of community resources (the "Care Map") and a marketplace for medical supplies (the "Care Store") operated by independent third-party vendors ("Vendors").
You must be at least 18 years old to create an account on TrueCare. By using the Platform, you represent that you have the legal capacity to enter into a binding agreement and that all information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Caregiver accounts go through an application and review process before they are activated, which may include identity verification, review of submitted documents, and reference checks. TrueCare reserves the right to approve, reject, suspend, or remove any account at its sole discretion, including after approval if new information comes to light.
Caregivers are solely responsible for the quality, legality, and safety of the services they provide. Clients are solely responsible for any decisions to hire, supervise, or terminate a relationship with a Caregiver. Any agreement regarding pay rate, schedule, duties, or working conditions is between the Client and the Caregiver directly; TrueCare is not a party to that agreement.
TrueCare asks Caregivers to disclose their background check status during the application process and allows Caregivers to optionally upload a background check report. Where TrueCare displays a "Background Verified" badge on a Caregiver's profile, this indicates that TrueCare staff have personally reviewed documentation related to that Caregiver's background check. It does not constitute a guarantee, warranty, or certification of the Caregiver's character, criminal history, or fitness for any particular role.
As part of the Caregiver application process, you may be asked to upload a government-issued photo ID, certifications, and background check documentation. These documents are stored securely and are used solely for identity verification and application review by TrueCare staff. We do not share these documents with Clients or other third parties except as required by law or as described in our Privacy Policy.

TrueCare provides in-app messaging to help Clients and Caregivers communicate before and during a care arrangement. To protect both parties, a Caregiver must accept a message request before a conversation can begin. TrueCare may monitor or review messages sent through the Platform for safety, fraud prevention, and quality purposes, and may share message content with law enforcement if required by law or if we believe in good faith that doing so is necessary to protect the safety of a user.
TrueCare's fee structure for Clients and Caregivers, including whether TrueCare charges a commission, subscription, or other fee for use of the caregiving marketplace, is subject to change. Any applicable fees will be clearly disclosed before you are charged. Payment for caregiving services rendered is arranged directly between the Client and the Caregiver unless TrueCare explicitly states otherwise in writing.
For purchases made through the Care Store, see Section 11 below for the applicable Vendor commission structure.
The Care Store is a drop-shipping marketplace. Products listed in the Care Store are owned, listed, and fulfilled by independent third-party Vendors, not by TrueCare. TrueCare does not hold inventory, warehouse products, or pack and ship orders. When a Client places an order, the Vendor is responsible for fulfilling, packing, and shipping that order directly to the Client.
Because Vendors are responsible for fulfillment, any issue with a product's quality, shipping delay, damage in transit, or fitness for a particular purpose should be directed to the Vendor first. TrueCare may assist in facilitating a resolution between a Client and a Vendor but is not the seller of record, does not take title to or possession of any product sold through the Care Store, and is not responsible for shipping times, packaging, or carrier handling.
Clients may leave a star rating and written review for a Caregiver after a care request is marked complete. Reviews must reflect a genuine, firsthand experience. TrueCare reserves the right to remove reviews that are fraudulent, abusive, or that violate these Terms.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TRUECARE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CAREGIVER, VENDOR, OR CLIENT WILL MEET YOUR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUECARE HEALTHCARE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING ANY HARM, INJURY, LOSS, OR DAMAGE ARISING FROM THE CONDUCT OF A CAREGIVER, CLIENT, OR VENDOR, WHETHER OR NOT TRUECARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TRUECARE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TRUECARE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold harmless TrueCare Healthcare, its owners, employees, and affiliates from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Platform, your violation of these Terms, or your interactions with another user.
TrueCare may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, posed a safety risk to another user, or engaged in fraudulent activity. You may stop using the Platform and close your account at any time by contacting us.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New York.
